3. No Guarantee of Profit, Performance, or Service Availability

  • The Developer does not guarantee that the Program will run uninterrupted, error-free, or continuously available (no specific SLA/uptime), including where the disruption originates from the server, hosting provider, or other third parties.

4. Limitation of Liability

  • To the extent permitted by applicable law, the Developer is not liable for any loss or damage of any kind — whether direct, indirect, incidental, consequential, special, exemplary, or punitive — including but not limited to loss of funds, loss of profit, or loss of data — arising from or related to: use or inability to use the Program, incorrect configuration by the user, software bugs/malfunctions, disruption or unilateral policy changes by third-party services (e.g. exchange, API, internet/hosting providers), hacking or unauthorized access to the user's account, regulatory changes, natural disasters, power/internet network disruptions, or other events of force majeure beyond the Developer's reasonable control.
  • This provision applies regardless of the legal basis of the claim (breach of contract, tort, or any other basis), and remains in effect even if the Developer has been advised of the possibility of such loss.
  • If the full limitation cannot be enforced under applicable mandatory law, the Developer's maximum liability (if any) is limited to the amount paid for the Program license in the last 6 (six) months.

5. Indemnification

  • By using the Program, the user agrees to defend, indemnify, and hold harmless the Developer (including its owner, team, and affiliates) from any demand, claim, loss, liability, cost, and expense (including reasonable legal fees) arising from: the user's use of the Program, the user's breach of these Terms & Conditions or this Disclaimer, trading decisions made by the user, or any law/regulation violation committed by the user.

6. Account & API Key Security

  • The user is fully responsible for the security of their exchange account, API keys, permissions, and risk/leverage settings.
  • The Developer does not store users' API keys and is not responsible for leaks resulting from poor security practices by the user or third parties.

7. Affiliation & Trademarks

  • Banaspati Auto Trading Bot is not affiliated with, sponsored by, or endorsed by Binance or any other entity. All trademarks are the property of their respective owners.

8. Information on the Website

  • Content on the website may contain technical or typographical errors. Information is provided for general/educational purposes and may change at any time.

9. Severability

  • If any part of this Disclaimer is held invalid, unenforceable, or unlawful by a court of competent jurisdiction, that part will be limited or removed to the minimum extent necessary, and the remaining parts of this Disclaimer will remain in full effect.

  • This Disclaimer may be changed at any time without prior notice. The latest version shown on this page supersedes any previous version.

11. Governing Law & Dispute Resolution

  • This Disclaimer is governed by and construed in accordance with the laws of the Republic of Indonesia.
  • Any dispute, disagreement, or claim arising from or related to the Program, the website, this Disclaimer, or the Terms & Conditions must first be settled through good-faith discussion within 30 (thirty) calendar days of either party giving written notice of the dispute.
  • If no agreement is reached through discussion, the dispute will be settled finally and bindingly through the courts, at the District Court having jurisdiction over the Developer's domicile, unless the parties otherwise agree in writing to pursue arbitration or another alternative dispute resolution mechanism.
  • Any claim or dispute may only be brought on an individual basis and not as part of a class action, consolidated suit, or similar mechanism, to the extent permitted by applicable law.
